Scheme compliance

WorkCover monitors compliance with the Workers Rehabilitation and Compensation Act 1986 (the Act) to protect the interests of workers and employers and ensure the long-term viability of the Scheme for all South Australians.

Under the Act we have the authority to:

  • issue fines or penalties to employers for non-payment of levy, late lodgement of claims, or failure to offer alternative duties to assist injured workers in their return to work
  • investigate a range of matters where there may be evidence of dishonesty, or intent to defraud the Scheme by claimants or employers
  • investigate evidence of dishonesty, overcharging, or intent to defraud the Scheme by medical or other service providers.

Fraud

Fraud results in lower profits, lower wages, lost jobs and higher prices for goods and services. Workers, employers, service providers such as medical and health practitioners, lawyers and interpreters commit fraud by:

  • obtaining a benefit for workers compensation dishonestly
  • making false statements (as opposed to mistakes)
  • providing false or misleading documents.
